FORMER EMPLOYEES ENJOINED FROM SOLICITATIONS IN EMPLOYEE RAIDING CASE

MINEOLA, NY – May 16, 2010 – A former corporate vice president and six other senior employees and consultants were temporarily enjoined from soliciting the work force of two Great Neck, NY-based wireless companies in an unfair competition action filed in the Supreme Court of New York, according to the plaintiff’s attorneys, McDaniel & Park, P.C.. Plaintiffs Ryan Pierce Group, Inc. and Tower West Communications, Inc., which provide construction services to wireless services providers, filed suit on May 10, 2010, seeking a temporary restraining order and preliminary and permanent injunctions against a former Vice President, Michael Brown of Shortsville, NY; four of the companies’ project managers, and software consultant Thomas Nyiri of Boulder, CO, alleging that the group had conspired to establish a new company by improperly soliciting their employer’s customers and using plaintiff’s equipment and intellectual property.

Supreme Court Justice Timothy S. Driscoll entered a temporary restraining order after McDaniel & Park, P.C. filed an emergent application in Supreme Court, Nassau County, on May 10 and ordered a hearing on the plaintiffs’ request for a preliminary injunction to be held on May 28, 2010. Former federal prosecutor Alan M. Friedman appeared on behalf of McDaniel & Park, P.C., a litigation boutique firm with offices in Hackensack, NJ and New York City.

The plaintiff companies are subsidiaries of Juniper Group, Inc., a publicly held corporation based in Great Neck.

The lawsuit alleges that Brown and the project managers, conspired to misappropriate the plaintiffs’ contracts, then used fraudulent means to convince members of two construction crews working for Ryan Pierce Group to abandon projects without notice. The lawsuit further alleges that Brown and Nyiri conspired to misappropriate proprietary on-line training programs. The complaint in the action alleges unfair competition, tortious interference and breach of fiduciary duty.
